Before engaging with any of our websites, newsletters, publications, social media channels, memberships, applications, events, or other services, we encourage you to read these Terms of Service so you understand your rights and responsibilities when using our properties.

PLEASE READ THESE TERMS OF SERVICE (“AGREEMENT”) CAREFULLY. THIS AGREEMENT IS A LEGAL CONTRACT BETWEEN YOU (“USER,” “YOU,” OR “YOUR”) AND GLAD YOU STAYED LLC (“GLAD YOU STAYED,” “GYS,” “COMPANY,” “WE,” “OUR,” OR “US”).

By accessing or using our Services, you agree to be bound by these Terms of Service and any future amendments thereto. If you do not agree to these Terms of Service, you may not access or use our Services.

These Terms of Service apply to all websites, publications, newsletters, memberships, subscription services, applications, social media accounts, podcasts, events, courses, creator programs, ambassador programs, affiliate programs, communities, print and digital products, physical merchandise, and all other content, products, and services owned, operated, licensed, or provided by Glad You Stayed LLC, including but not limited to Spill Babes, Glow Babes, Worth Staying For, and any current or future affiliated brands, properties, platforms, or services that link to or reference these Terms of Service (collectively, the “Services”).

By accessing or using the Services, you represent that:

(1) You are at least eighteen (18) years old or otherwise of legal age to enter into a binding contract in your jurisdiction;

(2) You have the authority to enter into this Agreement personally or on behalf of any organization or entity that you represent; and

(3) You agree to comply with all applicable laws and regulations while using the Services.

Your use of the Services may also be subject to additional terms, policies, community guidelines, contest rules, or subscription terms (“Supplemental Terms”), which are incorporated herein by reference.

We reserve the right to modify these Terms of Service at any time. Your continued use of the Services following any changes constitutes your acceptance of such changes.

  1. REGISTRATION; ACCOUNTS; SUBSCRIPTIONS

1.1 Registration Data

You agree to provide accurate, complete, and current information when registering for any account, membership, subscription, newsletter, event, or other Service.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

1.2 Memberships and Subscriptions

Additional subscription terms may apply at the time of purchase.

By subscribing to any Glad You Stayed newsletter, you consent to receiving electronic communications from us. You may unsubscribe at any time through the methods provided in our communications.

1.4 Sponsored and Affiliate Content

Our Services may contain sponsored content, affiliate links, advertisements, and paid partnerships.

Glad You Stayed may receive commissions or compensation from purchases made through affiliate links or sponsored relationships at no additional cost to you. Sponsored and affiliate relationships will be disclosed when required by applicable law.

1.5 Sweepstakes, Contests, and Giveaways

Sweepstakes, contests, giveaways, and promotional campaigns conducted through our Services shall be governed by their respective Official Rules, which are incorporated into these Terms unless otherwise stated.

1.6 Events

Glad You Stayed may host virtual or in-person events, conferences, retreats, workshops, and experiences. Additional terms may apply to event participation, attendance, ticket purchases, cancellations, recordings, and photography.

1.7 Creator, Ambassador, and Affiliate Programs

Glad You Stayed may offer creator, ambassador, contributor, or affiliate programs. Participation in such programs may require additional agreements and policies.

1.8 Removal of Accounts

We reserve the right to suspend, restrict, remove, or terminate accounts, memberships, subscriptions, usernames, or access to the Services at any time and for any reason permitted by law.

1.9 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated herein by reference.

  1. USER CONTENT

2.1 Responsibility for Content

You are solely responsible for all content that you submit, upload, publish, transmit, or otherwise make available through the Services (“User Content”).

User Content includes, but is not limited to:

  • comments;
  • reviews;
  • photographs;
  • videos;
  • testimonials;
  • interviews;
  • creator submissions;
  • contest entries;
  • direct messages;
  • newsletter submissions;
  • community discussions;
  • social media submissions;
  • questions and feedback;
  • audio recordings;
  • written stories and opinions; and
  • other materials voluntarily provided to Glad You Stayed.

2.2 Ownership of Your Content

You retain ownership of your User Content. However, you represent and warrant that you possess all rights necessary to submit such content and grant the licenses described in these Terms.

2.3 License to Your Content

By submitting User Content, you grant Glad You Stayed and its affiliated brands a perpetual, worldwide, irrevocable, non-exclusive, royalty-free, sublicensable license to:

  • use;
  • reproduce;
  • modify;
  • adapt;
  • publish;
  • distribute;
  • publicly display;
  • publicly perform;
  • translate;
  • create derivative works from; and
  • otherwise exploit such content

for commercial and non-commercial purposes across any existing or future media formats.

This includes the right to:

  • repost content across Glad You Stayed brands;
  • publish submissions in newsletters;
  • feature submissions in articles, podcasts, videos, and social media;
  • edit submissions for formatting, grammar, clarity, or length;
  • identify you by your provided name, username, or social media handle unless prohibited by law.

You acknowledge that you will not be entitled to compensation unless otherwise agreed to in writing.

2.4 Ratings and Reviews

Ratings and reviews represent the opinions of their respective users and do not necessarily reflect the views of Glad You Stayed.

We reserve the right to remove ratings or reviews at our sole discretion.

2.5 Community Standards

You agree not to submit content that:

  • violates applicable laws;
  • infringes intellectual property rights;
  • contains malicious software;
  • is defamatory or fraudulent;
  • constitutes harassment or hate speech;
  • contains unlawful pornography or obscene material;
  • impersonates another person or entity;
  • constitutes spam or deceptive advertising; or
  • otherwise violates these Terms of Service.
  1. OWNERSHIP OF COMPANY SERVICES

3.1 Ownership

Except for User Content, Glad You Stayed owns or licenses all rights, title, and interest in the Services and all intellectual property contained therein.

3.2 Trademarks

All trademarks, logos, service marks, trade names, branding materials, and related intellectual property appearing within the Services are the property of Glad You Stayed or their respective owners and may not be used without prior written permission.

3.3 Restrictions on Use

You agree not to:

  • reproduce or commercially exploit the Services;
  • scrape or harvest data from the Services;
  • use automated software to collect information from the Services;
  • reverse engineer any portion of the Services;
  • create competing services using our content;
  • gain unauthorized access to our systems;
  • interfere with the functionality of the Services;
  • remove copyright notices or proprietary markings; or
  • violate applicable laws while using the Services.

3.4 Artificial Intelligence Restrictions

You may not use any portion of the Services, including text, images, audio, video, metadata, databases, or other materials, for the development, training, fine-tuning, testing, or improvement of artificial intelligence or machine learning systems without Glad You Stayed’s prior written consent.

3.5 Third-Party Links

The Services may contain links to third-party websites, products, applications, or services.

We are not responsible for the content, policies, or practices of third parties and make no representations regarding such offerings.

3.6 Embedded Content

Certain Services may permit the embedding or sharing of videos or other media content. Embedded content may not be modified or used in violation of these Terms or applicable intellectual property laws.

  1. MERCHANDISE AND DIGITAL PRODUCTS

Glad You Stayed may offer:

  • physical merchandise;
  • digital products;
  • downloadable content;
  • templates;
  • guides;
  • courses;
  • memberships;
  • subscriptions; and
  • other paid offerings.

Additional terms relating to purchases, refunds, shipping, or licensing may apply at the time of purchase.

  1. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLAD YOU STAYED DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND ACCURACY.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE ERROR-FREE;
  • THE SERVICES WILL BE UNINTERRUPTED;
  • THE SERVICES WILL ALWAYS BE AVAILABLE;
  • CONTENT WILL BE COMPLETE OR ACCURATE; OR
  • THE SERVICES WILL BE FREE OF HARMFUL COMPONENTS.
  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLAD YOU STAYED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

(A) THE TOTAL AMOUNT PAID BY YOU TO GLAD YOU STAYED DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR

(B) ONE HUNDRED DOLLARS ($100).

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Glad You Stayed, its affiliated brands, officers, directors, employees, contractors, licensors, and representatives from any claims, damages, liabilities, expenses, or costs arising from:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms;
  • your violation of applicable laws; or
  • your infringement of third-party rights.
  1. TERMINATION

We reserve the right to suspend, modify, restrict, or terminate any portion of the Services or your access thereto at any time without prior notice where permitted by law.

  1. COPYRIGHT INFRINGEMENT

If you believe content available through our Services infringes your copyright, please submit written notice to:

We reserve the right to remove allegedly infringing content and terminate repeat infringers where appropriate.

  1. ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receive electronic communications from Glad You Stayed.

Users accessing the Services from outside the United States do so at their own initiative and are responsible for complying with applicable local laws.

  1. GOVERNING LAW

These Terms shall be governed by the laws of the State of New Jersey without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located within New Jersey, and you consent to the personal jurisdiction of such courts.

  1. ENTIRE AGREEMENT

These Terms of Service constitute the entire agreement between you and Glad You Stayed regarding the Services and supersede all prior agreements concerning the subject matter herein.
